Craig v. FedEx Ground Package System, Inc.
United States Court of Appeals for the Seventh Circuit
686 F.3d 423 (2012)

- Written by Sarah Holley, JD
Facts
A class of current and former FedEx drivers brought suit against FedEx (defendant), alleging that it had misclassified the plaintiffs as independent contractors rather than employees. The actions were consolidated and transferred to the U.S. District Court for the Northern District of Indiana. The court selected Craig, which was based on Kansas law, as its lead case. The district court then certified both a nationwide class and a number of statewide classes, because each case arose under a different state’s substantive law. The Kansas class (plaintiffs) consisted of 479 members alleging improper classification as independent contractors rather than employees under the Kansas Wage Payment Act (KWPA). The district court granted FedEx’s motion for summary judgment as to the plaintiffs’ employment status. The plaintiffs appealed.
