Crane v. Crane
Supreme Court of Utah
683 P.2d 1062 (1984)
- Written by John Yi, JD
Facts
The plaintiffs are holders of cattle grazing permits in the Water Hollow C & H Allotment. A dirt road passes through the defendants’ property to the national park within which the grazing area is located. The plaintiffs used this road to get to the allotment. The plaintiffs obtained their grazing permits from a predecessor who had used the trail to drive cattle since 1950. The plaintiffs claimed an easement by prescription to continue using the road. The trial court held that the plaintiffs did have an easement to use the road, but only for driving cattle.
