Facts
In 1979, California ratified Proposition I, an amendment to the California Constitution forbidding state courts from ordering mandatory pupil assignment or transportation, unless a federal court would do so to remedy a violation of the Equal Protection Clause. The California Court of Appeals upheld the constitutionality of Proposition I.
