Facts
France enacted a law that prohibited the resale of unaltered products for a lower price than the original purchase price. Bernard Keck and Daniel Mithouard were prosecuted for violating this law. Keck and Mithouard argued that the French law violated the provision of the Treaty of Rome that prohibits European Union (EU) member states from restricting the quantity of imports from other member states.
