Facts
Roberta Cripe plaintiff was the guardian and conservator of Roberta Schmitz. Thomas Leiter and the Leiter Group, an Illinois Professional Corporation (collectively, Leiter) (defendants), provided legal services to Schmitz. Cripe filed an action against Leiter in circuit court for violation of the Consumer Fraud Act (the act). Cripe alleged that Leiter included charges on legal invoices for time not actually spent providing legal services to Schmitz. Leiter filed a motion to dismiss. The court granted the motion and ruled that the act did not cover legal services or billing for legal services. Cripe appealed.
