Facts
Buckley Crispin (plaintiff) sued Christian Audigier, Inc. (defendant) over rights to Crispin’s commercial artwork. Christian Audigier subpoenaed several social-media Internet service providers to obtain email between Crispin and his customers, as well as Crispin’s Facebook wall postings, MySpace comments, and other social-media messages. Crispin moved to quash the subpoenas on the grounds that his social-media communications were protected from civil subpoenas by the 1986 federal Stored Communications Act (act). A magistrate judge denied Crispin’s motion. Crispin appealed to the district court.
