Facts
William Cronin (plaintiff) was driving a bread-delivery truck sold by J.B.E. Olson Corporation (Olson) (defendant) when an aluminum safety hasp broke and caused bread trays to strike and seriously injure Cronin during a car accident. Cronin sued Olson for a design defect under a theory of strict liability in tort. The trial court declined to instruct the jury that Cronin needed to establish that the truck’s defective condition made the truck unreasonably dangerous to consumers. The jury found in favor of Cronin. Olson appealed, arguing that the jury instruction was improper.
