Facts
Crosstex North Texas Pipeline, L.P. (defendant) built a compressor station that generated a loud, constant roar similar to a jet airplane next to the Gardiners’ (plaintiffs’) ranch. The Gardiners brought a lawsuit including claims for private nuisance against Crosstex. The trial court ruled in the Gardiners’ favor, but the appellate court reversed and remanded for a new trial. Both parties appealed, and the Texas Supreme Court granted review.
