- Written by Josh Lee, JD
Facts
El Dorado Investors (El Dorado) (plaintiff) sued Joseph Crouchman (defendant) for unpaid rent and for damages to the property that El Dorado had rented to Crouchman. The lawsuit was filed in a small-claims court in California, and the court awarded $1,500 in damages to El Dorado. Crouchman appealed to the superior court and demanded a jury trial. The superior court denied the jury request, and Crouchman appealed. The California Court of Appeal affirmed, and Crouchman petitioned the California Supreme Court for review.
