Facts
Crumpton (plaintiff) underwent surgery at a hospital owned by Humana (defendant). After the surgery, a nurse improperly lowered Crumpton’s bed, causing her injuries. Over the next three years, Crumpton received continuous treatment for her injuries and began settlement negotiations with Humana. More than three years after the date of her injury, Crumpton brought a medical malpractice claim against Humana. The trial court granted summary judgment in favor of Humana, ruling that the three year statute of limitations barred Crumpton’s claim.
