Facts
Cruz del Valle Bermudez and several other Venezuelan citizens with HIV/AIDS (collectively, the patients) (plaintiffs) petitioned the Venezuela Supreme Court for a writ of protection of their constitutional rights, alleging that the minister of health and social welfare (the minister) (defendant) had violated the patients’ rights by failing to provide adequate treatment for HIV/AIDS. Specifically, the patients alleged that by failing to provide certain medications, the minister had violated the patients’ (1) right to liberty and personal security, (2) right to equality and nondiscrimination, and (3) right to health, life, and access to science and technology. The minister responded that the ministry simply did not have enough funds in its budget to address the medical needs of all Venezuelans with HIV/AIDS.
