Facts
Cruz (plaintiff) bought a used vehicle from Ricky Smith (defendant), a car dealership, in December 1998. In December 2001, Cruz was inside the vehicle cleaning it when the airbags spontaneously deployed for no reason, causing him injury. Cruz brought a negligence suit against Ricky Smith. At trial, Cruz did not present any direct evidence of Ricky Smith’s negligence, but attempted to recover based on the doctrine of res ipsa loquitur. The trial judge granted Ricky Smith’s motion for summary judgment. Cruz appealed.
