Facts
In 1973, Mr. Cummings (defendant) and Ms. Anderson (plaintiff) purchased a residence as tenants in common. Both split the closing costs equally, and made their monthly payments out of a joint bank account the couple held. In 1975, Ms. Anderson left the residence, taking with her much of the property in the home. Mr. Cummings continued to make all payments on the house. Ms. Anderson then brought suit for the one-half interest she claimed in the property. The trial court determined that the parties’ contributions were equal, and that Ms. Anderson abandoned her interest by leaving the residence. Ms. Anderson then appealed, with the court of appeals determining that Ms. Anderson was entitled to one-half of the value of the property. Mr. Cummings petitioned for certiorari to the Supreme Court of Washington.
