Facts
Grace Outten (defendant) was driving when she hit a car operated by Val Cunningham (plaintiff). Outten was found guilty of “Inattentive Driving” in violation of a Delaware statute. 21 Del. C. § 4176(b). Cunningham sued Outten, alleging that her negligence had caused him harm. Cunningham moved for partial summary judgment, contending that Outten’s liability for negligence had been established by her criminal conviction. Outten opposed the motion.
