Facts
Catts (defendant) is a tomato farmer. Curtice Brothers Co. (Curtice) (plaintiff) is a tomato packing plant. Curtice contracted to purchase all of the tomatoes grown on a certain piece of property owned by Catts. Six weeks before harvest time, Curtice began preparing for the tomatoes it expected to receive from Catts by purchasing the required packing materials and equipment and hiring additional labor. Catts refused to furnish the tomatoes to Curtice as agreed. Curtice brought suit in the Court of Chancery of New Jersey, a court of equity, seeking specific performance of the contract.
