Facts
Custom Communications Engineering (Custom) (plaintiff) was a dealership company that sold and serviced consumer equipment. E. F. Johnson co. (Johnson) (defendant) was a company that manufactured radio equipment. Custom and Johnson entered into a contract that Custom claims gave Custom exclusive rights to sell and service Johnson brand equipment in northern New Jersey. The contract was a buyer-and-seller agreement. In 1978, Johnson allowed rival retailers in the northern New Jersey area to sell Johnson inventory. Johnson also made deals with other retailers in Custom’s territory between 1981 and 1982. Determining this action to be contrary to their agreement, Custom brought suit against Johnson in 1988.
