Facts
John Cutchin (plaintiff), an experienced scuba diver, sued Habitat Curacao-Maduro Dive Fanta-Seas, Inc. (Habitat) (defendant), a dive resort in the Netherlands, after he was injured during a scuba-diving trip. Before the dive, Cutchin executed a “Liability Release and Express Assumption of the Risk” that waived Cutchin’s right to sue Habitat. Habitat moved for summary judgment, arguing that Cutchin could not sue because he signed the release.
