Facts
FAS Technologies, Inc. (“FAS”) (plaintiff) held the ‘837 patent for a specific type of pump. FAS then sued Cybor Corporation (“Cybor”) (defendant) for patent infringement based on a very similar type of pump. The U.S. District Court for the Northern District of California held the Cybor’s pump infringed on the ‘837 patent and Cybor appealed, arguing that the district court erred in construing the claims instead of the jury.
