Dace v. Doss
Arkansas Court of Appeals
530 S.W.3d 893 (2017)
- Written by Jamie Milne, JD
Facts
When Harold Dace (defendant) and Debra Doss (plaintiff) divorced in 2012, Dace was ordered to pay Doss $619 per month in alimony for the remainder of Doss’s life. Doss remarried in 2015. Upon learning of Doss’s remarriage, Dace stopped making alimony payments. Although Doss’s new husband covered some of her expenses, such as rent and utilities, Doss’s income from hairdressing remained insufficient to cover her other monthly bills. Doss filed a motion for contempt against Dace for his termination of alimony in violation of the divorce decree. After considering all the circumstances, the trial court entered a new order that required Dace to make ongoing alimony payments in the reduced amount of $234 per month. Dace appealed.
