Facts
Flora Graham (plaintiff) entered a fun house at a county fair. Unbeknownst to Graham, the fun house included strong fans that blew air upward. When Graham was walking over the fans, they blew air up her dress, exposing her underwear. At that exact moment, a photographer for the Daily Times Democrat (the newspaper) (defendant) took Graham’s picture. The newspaper published the photograph on the front page. Graham sued the newspaper for invasion of her right to privacy. The trial court ruled in Graham’s favor. The newspaper appealed.
