Facts
Charles Daines (plaintiff) sued Robert Harrison (defendant), the Park County sheriff, after Daines was dismissed from his employment with the Park County Sheriff’s Department. Daines and Harrison settled the lawsuit at a conference before a federal magistrate. Confidentiality was one of the terms of the agreement, and the agreement was not part of the court’s records. The magistrate ordered that the terms of the settlement be kept confidential. Subsequently, The Fairplay Flume (Fairplay) newspaper requested access to the settlement agreement. On learning that the terms of the settlement were being kept confidential pursuant to the magistrate’s order, Fairplay filed a petition to have the order vacated.
