Daniels v. Atlanta National League Baseball Club
Georgia Court of Appeals
524 S.E.2d 801 (1999)
- Written by Steven Pacht, JD
Facts
Geraldine Daniels (plaintiff) attended a home game of the Atlanta National League Baseball Club, Inc. (club) (defendant). While walking down some stairs on her way out of the stadium after the game, Daniels slipped and fell on either a cup or the liquid from a cup. Daniels did not know who dropped the cup or for how long the cup was on the floor before her accident. Per Daniels, at the time of her fall, no employees of the club or the stadium were in the immediate area. Daniels sued the club, alleging that the club was negligent because it did not exercise ordinary care in keeping the stadium safe. The club moved for summary judgment, which the trial court granted. Daniels appealed.
