Facts
Frederick Daniels (defendant) was charged with rape. At trial, the prosecution called the victim’s mother, Jessie Scott, as a witness. Scott testified that the victim had told her on the morning after the alleged rape that she was scared because Daniels had raped her. The trial court permitted the testimony, over the defendant’s objection, under Michigan Rule of Evidence 803(3), which permitted statements of a declarant’s state of mind as an exception to the hearsay rule. Daniels was convicted. He then filed a petition for writ of habeas corpus, which was denied. Daniels appealed.
