Daniels v. State
Georgia Supreme Court
78 Ga. 98 (1886)

- Written by Kelli Lanski, JD
Facts
George Daniels (defendant) was convicted of burglary after breaking into and entering a railroad-depot building where valuable goods were stored. The outer door to the building was open, but Daniels broke into inner rooms within the building and stole some goods. Daniels appealed his conviction, claiming that because the exterior door to the depot was open, he did not break into or enter the building illegally.
