Facts
A ranch sued a developer for breaching a settlement agreement. The trial court found for the developer. The court of appeals reversed. The developer instructed its lawyer, John Pappas (defendant) to petition the supreme court for review. Pappas filed the petition late and failed to properly seek an extension. Judgment was entered against the developer. Larry Daugert (plaintiff), the developer’s trustee, sued Pappas for malpractice. The court instructed the jury to decide whether the developer lost a chance to reverse the judgment and whether Pappas’s negligence was a substantial factor in causing the developer’s loss. The jury found there was a 20 percent chance the supreme court would have granted review and reversed. Judgment was entered against Pappas. Pappas appealed. The case was transferred to the supreme court.
