Facts
David M. (plaintiff) and Margaret M. (defendant) were married with a child, Timothy. Margaret was primarily responsible for nurturing Timothy. David filed for divorce and sought custody of Timothy. Margaret also sought custody. Although Margaret had committed adultery, there was no evidence indicating that her adulterous conduct had harmed Timothy. The trial court granted custody to David. Margaret appealed.
