Facts
The director of public prosecutions (the director) (plaintiff) charged Tasco Luc de Reuck (defendant) with the possession and importation of child pornography. De Reuck argued that the criminal statute’s definition of pornography was overbroad because it included within it simulated depictions of such acts and, therefore, deprived him of his constitutional right to privacy, freedom of expression, and equality.
