Facts
Dealers Hobby, Inc. (plaintiff) leased a commercial space from Marie Ann Linn Realty Co. (defendant) for 15 years. Under the lease agreement, Marie Ann was required to maintain the roof. After a heavy rain, a small portion of the roof collapsed and damaged some of Dealers’ property. The city inspected the premises and discovered that the building did not comply with several building codes. While the roof was being repaired, Dealers continued to use the property, and Dealers continued to use the property after the repair. Dealers sued Marie Ann for damages, claiming that it was entitled to the difference between the fair rental value of the premises as warranted and the fair rental value of the premises as they were during Dealers’ occupancy.
