Facts
Marshall Bruce Mathers, III, a/k/a Eminem Slim Shady (defendant) and DeAngelo Bailey (plaintiff) attended the same grade school during the same time period. Bailey brought suit against Mathers for false light invasion of privacy following the release of Mather’s song “Brain Damage” and an article published in Rolling Stone Magazine, which featured an interview with Mathers about the song. The lyrics described an alleged incident where Bailey beat up Mathers in the bathroom of the school, and the interview contained statements attributed to Bailey regarding the same. Bailey argued that the lyrics contained in the song “Brain Damage” and the statements attributed to him in the Rolling Stone article were untrue, placed him in a false light, and harmed his reputation. Mathers filed a motion for summary judgment, arguing the lyrics and statements were not actionable under the substantial-truth doctrine.
