Facts
The federal government considered granting national-monument status to the Florissant Fossil Beds, a geologically unique, 6,000-acre area of fossil beds in Colorado. At the same time, Park Land Company (defendant), a private developer, pushed for the construction of subdivisions in the area. A group known as Defenders of Florissant, Inc. (plaintiff) filed an action to enjoin the subdivision construction in federal district court. The court denied the motion for injunction. Defenders of Florissant appealed to the United States Court of Appeals for the Tenth Circuit.
