Facts
Douglas Degenhardt (plaintiff) occupied a room in a 15-room building owned by EWE Limited Partnership (EWE) (defendant). The majority of the occupants stayed at the building for months, such that they made payments to EWE on a monthly basis. Degenhardt was arrested for disorderly conduct and spent the night in jail. Upon returning to the building the next day, Degenhardt was told that he was no longer welcome. The police escorted Degenhardt from the premises. EWE did not obtain judicial authorization before evicting Degenhardt from the building. Degenhardt brought suit, alleging that he was illegally evicted by EWE. The trial court ruled in favor of Degenhardt and awarded him damages. EWE appealed.
