Facts
Carla Deitsch (plaintiff) hired The Music Company’s (the Company) (defendant) four-piece band to play at her wedding reception for $295. At the time the parties signed the performance contract, Deitsch paid a deposit of $65 and the Company agreed to provide music at the reception for several hours. After the band failed to appear at the reception Deitsch filed suit against the Company for breach of contract. A jury found in favor of Deitsch and the court considered the appropriate amount of damages to be awarded.
