Facts
Sandor Demkovich (plaintiff), a gay man, was the music director at a Roman Catholic church called St. Andrew the Apostle Parish (the church) (defendant). As music director, Demkovich assisted in the celebration of Mass. Reverend Jacek Dada, the church’s pastor, repeatedly subjected Demkovich to derogatory comments about Demkovich’s sexual orientation. Demkovich brought suit against the church, bringing a number of claims. One claim alleged that Jacek’s derogatory comments about Demkovich’s sexual orientation created a hostile work environment in violation of Title VII of the Civil Rights Act of 1964 (Title VII). The district court dismissed Demkovich’s hostile-work-environment claim based on sexual orientation, finding that the claim was barred by the First Amendment to the United States Constitution. The court of appeals reversed. Later, the court of appeals decided to rehear the case en banc.
