Facts
Design 22-Shark Deluxe Furniture, Ltd. (Design 22) (plaintiff) owned a chain of furniture shops in Israel. An Israeli statute known as the Hours of Work and Rest Law prohibited employers from having Jewish employees work on the Sabbath and having non-Jewish employees work on Friday or Sunday, unless special permission had been granted by the Ministry of Labor. Design 22 had Jewish employees work during the Sabbath and was fined for violation of the Hours of Work and Rest Law. Design 22 then sought special permission from the head of the Branch for Sabbath Work Permits in the Ministry of Labor, Tzvikah Rozenweig (defendant), to allow Design 22’s Jewish employees to work on the Sabbath. Rozenweig denied the special permit, and Design 22 filed a petition challenging the Hours of Work and Rest Law as invalid for violating the right to freedom of occupation.
