Facts
Robert Dezero (plaintiff) installed a heating appliance in Peter Turner’s (defendant) home. Before the installation, Turner represented to Dezero that Turner had interest in the home, had received money from the estate, had the money in his possession, and would use a portion of the money to pay Dezero once the work was done. Dezero finished the work, but Turner failed to pay Dezero as promised. Dezero brought suit against Turner for deceit. The lower court found for Turner.
