Facts
Godawari Marble Industries (defendant) operated in Godawari under a license granted by the government. Residents of Godawari were concerned that the activities of Godawari Marble Industries were causing environmental degradation in the area. Dhungel (plaintiff) filed a writ petition under the Constitution of Nepal asking the court to cancel the license because the issuance of the license was not in the public interest. Dhungel also asked for regulatory and remedial actions to stop or reduce environmental degradation.
