Facts
Watson (defendant) was an officer who carried a gun. Watson was in an area where he appeared to be alone. Watson discharged his gun. However, Watson was not actually alone, and he accidently fired a shot into Dickenson (plaintiff). Dickenson lost sight in one of his eyes because of the gunshot. Dickenson brought suit against Watson for assault and battery. The lower court found in favor of Watson, and Dickenson appealed.
