Facts
The director of insurance for the State of Illinois (the director) (plaintiff) sued Working Solutions, Inc. (Solutions) (defendant) in trial court for underpayment of contributions to a workers’-compensation self-insurance pool. In 2002 the director and Solutions reached a settlement agreement, and the court dismissed the case. The dismissal order stated that the case was dismissed with prejudice pursuant to the terms of the settlement agreement and that the court retained jurisdiction to enforce the agreement. The settlement agreement required Solutions to make payments to the insurance pool in 42 monthly installments. In 2005 the director filed a motion seeking enforcement of the settlement agreement, alleging that Solutions had stopped making the required payments. Solutions responded that the trial court lacked jurisdiction to enter an order enforcing the agreement. The trial court found that it had jurisdiction and entered judgment against Solutions. Solutions appealed.
