Facts
Croatian forces captured T. (defendant) and interned him in a prisoner-of-war (POW) camp. The Croatians designated T. as a watchman over his fellow POWs. In 24 separate incidents, T. allegedly assisted his captors in beating, kicking, and bludgeoning T.’s fellow POWs, killing two POWs. T. subsequently found his way to Denmark, where the Danish director of public prosecutions (prosecutor) (plaintiff) charged T. with war crimes under Danish legislation that enforced Geneva Conventions III and IV, pertaining to the wartime treatment of POWs and civilians, respectively. The prosecutor backed up these charges with suitable evidence. T. pleaded that his alleged crimes were not such grave violations of the Geneva Conventions as to give the Danish high court jurisdiction to hear the case.
