Facts
Perini North River Associates (Perini) (defendant) had a contract to build a sewage-treatment facility extending out over the Hudson River in New York City. Raymond Churchill (plaintiff) was employed by Perini and was injured while working on a barge supervising the unloading of construction materials. Churchill filed a claim for compensation under the Longshoremen’s and Harbor Workers’ Compensation Act (LHWCA). Perini claimed that Churchill was not covered by the LHWCA. An administrative-law judge agreed with Perini, holding that Churchill was not covered because he was not engaged in maritime employment as his job was not related to commerce on navigable waters. The Benefits Review Board affirmed the decision. Churchill appealed, and the director of the Office of Workers’ Compensation Programs (plaintiff) participated as a respondent in support of Churchill. The court of appeals upheld the administrative-law judge’s decision, and Churchill appealed.
