Ireland (plaintiff) requested access to redacted information from reports prepared as part of the approval process for the commissioning of a mixed-oxide plant to treat nuclear fuels in the United Kingdom (UK) (defendant) based on Ireland’s understanding of Article 9 of the 1992 Convention for the Protection of the Marine Environment of the North-East Atlantic (the OSPAR Convention). The UK refused to provide the information requested based on the UK’s interpretation of the OSPAR Convention. The matter was brought to the OSPAR Arbitral Tribunal for a resolution.
