Facts
The District (defendant) removed Hampton’s (plaintiff) daughter from her home due to improper care. The District placed Hampton’s daughter in the care of a foster mother, Stevenson. The District had basic requirements for a foster home, but did not dictate the day-to-day activities at foster homes within the District. While Stevenson left her foster children alone one day, her sons beat Hampton’s daughter to death. Hampton brought a survival action against the District, claiming that it was vicariously liable for Stevenson’s negligence. The jury returned a verdict in favor of Hampton.
