Facts
Doctorman (plaintiff) entered into a contract to purchase a parcel of real property from Schroeder (defendant). The contract required Doctorman to make an advance down payment and pay the remaining balance by December 19. Doctorman could not deliver the remaining balance on December 19 and negotiated an extension requiring her to pay the balance on or before 2:30 p.m. on December 20. Doctorman arrived with the remaining balance roughly a half hour after the deadline. Schroeder was still waiting at the specified location but refused to accept Doctorman’s payment. Schroeder declared the purchase agreement null and void. Doctorman filed suit seeking specific performance. The trial court dismissed Doctorman’s complaint. Doctorman appealed.
