Facts
R. M. Dodge (plaintiff) brought an ejectment action against Irvington Land Company (defendant). The trial court ruled in Dodge’s favor, finding that Dodge was in actual possession of the government-owned land at issue at the time Irvington entered upon the premises, and that there was no evidence that Dodge had abandoned the property. Irvington appealed.
