Facts
John Doe (plaintiff) was a United States Postal Service mail carrier who was HIV positive. One of his coworkers, Cathy Duncan (defendant) found out about his status and approached coworkers to spread that information. One of the coworkers that Duncan approached was a close friend of Doe and already knew Doe’s health status. Doe filed suit against Duncan for invasion of privacy. Duncan moved for summary judgment, and the trial court granted the motion. Doe appealed. The appeals court affirmed the decision, and Doe appealed again.
