Facts
Jane Doe (plaintiff) was a medical technologist for St. Michael’s Medical Center of Newark (St. Michael’s) (defendant). Doe lived in a dormitory provided by St. Michael’s, and she paid rent to live in the dormitory. Although Doe was not required to live in the dormitory, she was unfamiliar with the Newark area when she got the job with St. Michael’s, did not have friends in the area, and did not have the resources to live elsewhere, so the dormitory was her only option for a place to live. Doe worked Monday through Friday and occasionally was on call on Saturdays. One Saturday night when she was not on call, Doe was sexually assaulted and robbed in her dormitory room. Doe filed a negligence claim against St. Michael’s in a New Jersey trial court, alleging that St. Michael’s did not provide adequate security in the dormitory. St. Michael’s argued that because her claim was covered by workers’ compensation, she could not file a civil action against St. Michael’s. The trial court agreed with St. Michael’s and dismissed Doe’s claim. Doe appealed.
