Facts
Richard Carsten (plaintiff) brought an action in trial court against Patricia Dosdourian and Christine DeMario (defendants) for personal injuries. Before trial, Carsten filed a motion to prevent disclosure to the jury that Carsten had entered into an agreement under which Carsten settled all claims against DeMario in return for payment of DeMario’s insurance-policy limits and DeMario’s continued participation in the litigation through judgment. The trial judge granted Carsten’s motion. After trial, Dosdourian appealed, arguing that the settlement agreement should have been permitted to be disclosed. The appeals court affirmed and then certified a question regarding the disclosure of settlement agreements such as the one with DeMario.
