Facts
James Dryden, individually, and Paul R. Minasian and Malcolm R. Minasian, a partnership, (Dryden) (plaintiffs) sued Tri-Valley Growers (Tri-Valley) and several unnamed persons (defendants) on tort theories of intentional interference with contractual and/or advantageous economic and business relationships regarding Dryden’s contractual relationship with Villa D’Oro. Dryden had contracts to purchase certain waste products from Villa D’Oro, an olive oil processing plant that was purchased by Tri-Valley. The gist of Dryden’s grievance was that Tri-Valley’s purchase of Villa D’Oro unjustifiably interfered with and induced the breach of its contracts with Villa D’Oro. Tri-Valley filed a general demurrer to the original complaint that was sustained with leave to amend. Tri-Valley also demurred to the third, fourth, fifth, and sixth causes of action in Dryden’s first amended complaint, alleging that they failed to allege sufficient facts. The trial court again sustained the demurrer but this time without leave to amend. Dryden appealed.
