Facts
Chester Dubil died as a result of the negligence of Philip Labate (defendant). Margaret Dubil (plaintiff) sued for wrongful death on behalf of herself and the four children she had with Chester. Prior to the trial, Margaret remarried. The trial court held that Margaret getting remarried was not relevant and could not be mentioned to the jury. Labate filed an interlocutory appeal challenging that holding.
