Facts
A group of students at Portage Path Elementary School, which was part of the Akron Public Schools school district (district) (defendant), were playing on the playground. Several students tied some jump ropes together so that they could play tug of war. An announcement had been made over the intercom at the school that tying jump ropes together in order to play tug of war was against the rules. The students attempted to hide themselves from the view of the supervising teachers, who were talking among themselves. One student, Courtneah DuBose (plaintiff), wrapped the rope around her arm to help secure her grip. During the tug-of-war game, DuBose suffered severe rope burns. DuBose sued the district under a theory of negligent supervision on the part of the teachers. The trial court granted the district’s motion for summary judgment, and DuBose appealed.
